1. Acceptance and Binding Effect

These Terms govern access to and use of BharatPahchan.com. By browsing, registering, creating or claiming a profile, submitting material, purchasing a service, advertising, communicating with the Platform or otherwise using it, you agree to these Terms together with the Privacy Policy, Disclaimer, Refund & Cancellation Policy and any service-specific written terms shown before purchase. If you do not agree, do not use the relevant service.

2. Operator and Private Status

BharatPahchan.com is operated by CITILINE TECHNOLOGIES PRIVATE LIMITED. BharatPahchan is a private platform. It is not a Government of India, State Government, local-government, UIDAI/Aadhaar, Election Commission, statutory authority or official government identity registry. A profile, badge, claim, listing or verification does not constitute government certification, appointment, statutory recognition, licence or endorsement unless expressly stated and supported by the relevant authority.

3. Nature and Evolution of Services

The Platform may provide searchable identity/profile pages, directories, profile claiming and verification, public information, recognition and visibility services, digital promotion, media references, advertising, subscriptions, listings, digital products and other present or future services. Features may be introduced, changed, restricted, suspended or discontinued, subject to existing contractual commitments and mandatory law.

4. Eligibility and Authority

You must have legal capacity to enter into a binding contract for paid or contractual services. If you act for a company, institution, public figure, professional, minor or another person, you represent that you have the authority required for the action you take. We may require evidence of authority.

5. Accounts, Credentials and Security

You must provide materially accurate information, keep credentials and OTPs confidential, maintain a secure device and promptly report suspected unauthorised access. You must not create a deceptive, fake or impersonating account, or sell, transfer or lend a verified account where doing so would mislead users. CTPL may require re-authentication or re-verification where security or identity is in doubt.

6. Profile Creation, Claiming and Control

Profiles may be created from user submissions, authorised submissions or lawful public sources. The existence of a profile does not mean the person has personally created or endorsed it. A person claiming a profile may be required to demonstrate identity or authority. CTPL may resolve competing claims, freeze editing while a dispute is investigated, or reject a claim that cannot be reliably verified.

7. Verification

Verification means only that CTPL has carried out the checks expressly described for the relevant verification service. Verification is not government certification, police verification, a character certificate, professional licensing, creditworthiness assessment, guarantee of authenticity of every statement, or endorsement of future conduct. Verification may be refused, suspended or revoked if evidence is false, inconsistent, expired, disputed or misleading.

8. Accuracy and Public-Source Information

The Platform may compile information from lawful public sources and third-party submissions. Such information may become outdated, incomplete or disputed. Users must independently verify information before relying on it for legal, financial, medical, employment, electoral, matrimonial, commercial or other consequential decisions. A correction mechanism is available through the official grievance contact.

9. User Submissions and Responsibility

You are responsible for material you submit. You represent that you have the rights, authority, consent or lawful basis required to submit it and that it is not knowingly false, forged, defamatory, privacy-invasive, obscene, threatening, infringing, deceptive or otherwise unlawful. You must provide source or substantiation where reasonably requested.

10. Licence for Submitted Content

To the extent necessary to operate the Platform and the service you request, you grant CTPL a non-exclusive, worldwide, royalty-free licence to host, reproduce, resize, format, translate where authorised, display, distribute, technically process, cache and make available submitted content. This licence does not transfer ownership of your intellectual property and is subject to applicable law and any service-specific agreement.

11. Prohibited Conduct

You must not impersonate another person; submit forged or manipulated documents; falsely claim government affiliation; publish unlawful personal data; defame, threaten, harass or stalk; infringe copyright or trademark; upload malware; attempt unauthorised access; disrupt the Platform; bypass technical controls; unlawfully scrape or harvest data; use bots to manipulate metrics; conduct phishing, fraud or chargeback abuse; or use BharatPahchan to facilitate any unlawful activity.

12. Cyber Security and Automated Access

No user may probe, scan, test, attack or circumvent Platform security without written authorisation. Automated collection, crawling, scraping, bulk extraction or use of Platform data for model training, resale, profiling or competing databases is prohibited where it violates law, robots/technical restrictions, intellectual-property rights, privacy rights or these Terms. Search engines acting in the ordinary course may be permitted subject to technical controls.

13. AI, Deepfakes and Synthetic Information

Users must not use the Platform to create, upload or distribute unlawful deepfakes, deceptive impersonation, manipulated evidence or synthetic material intended to mislead. Where applicable law or Platform design requires disclosure or labelling of synthetically generated information, users must comply. CTPL may label, restrict, de-index, preserve or remove synthetic content where appropriate.

14. Intellectual Property

Except for third-party and user-owned material, the Platform's software, source code, design, compilations, databases, original text, graphics, brand assets, workflows and proprietary materials are owned by or licensed to CTPL. Access to the Platform does not transfer ownership or grant a licence except the limited right to use the service in accordance with these Terms.

15. Brand and Trademark Restrictions

BharatPahchan, Channel009 and associated names, marks, logos, layouts or trade dress may not be copied or used to imply sponsorship, government affiliation, franchise, partnership, verification authority or endorsement without written permission. Third-party marks remain the property of their respective owners.

16. Copyright, Trademark and Other Rights Complaints

A rights holder alleging infringement should email bharatpahchan.helpline@gmail.com with the exact URL, identification of the protected work/mark, explanation of the alleged infringement, proof of authority and contact information. CTPL may seek clarification, temporarily restrict material, notify the uploader where appropriate, and take action required by applicable law.

17. Privacy, Impersonation and Takedown Complaints

A person alleging impersonation, unlawful disclosure of personal data, fake identity, defamatory content or another legal violation should identify the exact URL/material, explain the issue and requested action, and provide proportionate evidence of identity or authority. False or abusive complaints may themselves violate these Terms or applicable law.

18. Paid Services and Service Descriptions

Prices, taxes, duration, deliverables, eligibility, inclusions, exclusions and special conditions shown on the service page, checkout, quotation, order form, invoice or written agreement form part of the transaction. Users should review them before payment. If there is a direct conflict, a specifically negotiated written agreement signed/accepted for that service prevails over general website terms to the extent of the conflict.

19. Payments, Taxes and Invoices

Users must use lawful payment instruments and accurate billing information. Payments may be handled by third-party gateways. Applicable taxes, deductions and statutory charges will be dealt with according to law. A payment receipt does not by itself prove eligibility for a verification, publication or service where separate compliance requirements apply.

20. Refunds and Cancellations

Refunds and cancellations are governed by the Refund & Cancellation Policy and any service-specific written terms. Nothing in these Terms removes consumer remedies or other statutory rights that cannot lawfully be waived.

21. Advertising, Sponsored Profiles and Promotions

Advertisers and sponsors are responsible for legality, accuracy and substantiation of their claims and for required disclosures. CTPL may reject, suspend or remove advertising that violates law, Platform rules, third-party rights or public safety. Publication of an advertisement, sponsored profile or promotional material is not an endorsement by CTPL.

22. Third-Party Links, Services and Transactions

External links, embeds, payment providers and third-party services may be offered for convenience or functionality. CTPL does not control independent third parties and is not responsible for their separate products, contractual performance, privacy practices or security. Users should conduct their own due diligence.

23. Moderation, Correction and Removal

CTPL may review, label, correct, restrict, de-index, suspend or remove content where reasonably necessary for security, suspected fraud, impersonation, legal compliance, infringement, breach of these Terms or protection of users and third parties. Where applicable law requires notice, reasons, opportunity or a grievance mechanism, CTPL will follow the legally applicable process.

24. Suspension and Termination

We may suspend or terminate access for material or repeated breach, fraud, forged verification, cyber attack, impersonation, unlawful content, non-payment or conduct creating substantial risk. Termination does not erase accrued payment obligations, legal claims, evidence-preservation duties or provisions intended by their nature to survive.

25. Electronic Communications and Evidence

Where permitted by law, you consent to receive transactional, account, security and legal communications electronically. Electronic acceptance, emails, OTP records, payment records, system logs, access records and other electronic records may be maintained and relied upon to the extent permitted by applicable evidence and electronic-record law.

26. No Professional Advice

Unless CTPL expressly contracts to provide a specific professional service through an appropriately qualified person, general Platform content is not legal, medical, financial, investment, tax, matrimonial, employment or other regulated professional advice.

27. No Guaranteed Outcome

We do not guarantee search-engine ranking, public reputation, verification approval, publicity, business leads, income, employment, electoral or political outcome, media coverage, social-media reach or action by any government or third party. A paid service is limited to its stated deliverables.

28. Disclaimer of Warranties

To the extent permitted by law, the Platform is provided on an as-available basis. CTPL does not warrant that every public-source item is error-free or that service access will always be uninterrupted. This clause does not override an express service commitment or statutory guarantee that cannot lawfully be excluded.

29. Limitation of Liability

To the maximum extent permitted by law, CTPL and its officers, employees and contractors are not liable for indirect, incidental, special, punitive or consequential losses arising solely from use of general Platform content, third-party conduct or events beyond reasonable control. Nothing excludes liability for fraud, wilful misconduct, statutory consumer liability or any other liability that applicable law does not permit to be excluded.

30. Indemnity

To the extent permitted by law, a user whose unlawful submission, infringement, impersonation, fraud, cyber abuse or material breach causes a third-party claim or direct loss shall indemnify CTPL against resulting direct liabilities, reasonable legal costs and claims, subject to applicable law and principles of causation.

31. Force Majeure

CTPL is not responsible for delay or failure caused by events beyond reasonable control, including natural disasters, widespread network/cloud outages, war, civil disturbance, governmental action, power failure, major cyber incidents or failure of critical third-party infrastructure, subject to mandatory legal rights.

32. Changes to Services and Terms

We may revise these Terms prospectively for changes in law, risk, technology or services. Material changes will be posted and, where law requires, separately notified or accepted. Changes do not retrospectively remove accrued statutory rights.

33. Grievance Redressal

Complaints may be sent to the Grievance Officer / Support Contact at bharatpahchan.helpline@gmail.com with the relevant URL/account/order, description, requested action and supporting information. CTPL may seek identity or authority verification and will process the grievance within timelines required by the applicable law.

34. Governing Law and Jurisdiction

These Terms are governed by Indian law. Parties should first attempt good-faith resolution through the grievance mechanism. Subject to mandatory statutory forums and non-waivable rights, competent courts at Jaipur, Rajasthan shall have jurisdiction. Nothing prevents a consumer, data principal or other person from approaching a forum or authority that applicable law entitles that person to approach.

35. Severability, Waiver and Entire Terms

If a provision is held unenforceable, the remaining provisions continue to the extent lawful. Failure to enforce a provision is not a waiver of future enforcement. These Terms, the incorporated policies and any applicable service-specific written terms constitute the agreement governing use of the relevant Platform service.
